Sky Better - Little Wins on the Heart Network, October – November 2024 – Specific Rules 
  
1.    The Sky Better ‘Little Wins’ promotion (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from Wednesday 30th October 2024 to Wednesday 13th November 2024 on the Heart Network. Global is the Promoter. The ‘Promotion Partner’ mentioned in these Specific Rules is Sky and the ‘Prize Provider’ is NDL.  

2.    IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here (together, the ‘Promotion Terms and Conditions’). Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions. 

Details of the Promotion: 

3.    To enter the Promotion, you must: 

4.    go online to the Promotion entry page at heart.co.uk/win and register your details; 

5.    answer the question telling us in 250 characters or less about a ‘little win’ you’ve experienced, where a situation has turned out better than expected (your ‘Submission’). 

6.    You must complete all sections on the entry form for your entry to be included in this Promotion.  

7.    Entries will be judged by a panel of judges including one independent judge on the following criteria:  
        a.   how “feel-good” the Submission is; 
        b.  how unique the Submission is;   
        c.  how entertaining the Submission is; and 
        d.  how aligned the Submission is with the theme of ‘little wins’. 

8.    Entries deemed by us to be rude, offensive, defamatory, illegal or condoning dangerous behaviour will be removed from the Promotion. 

9.    Online entry will open at 17:00 on Wednesday 30th October 2024 and close at 09:00 on Wednesday 13th November 2024. Entries received before or after this time will not be included in the Promotion. 

10.    The Submissions will be judged at the following times:  

        a).    On Friday 8th November 2024 all entries received between 17:00 on Tuesday 29th October  and 09:00 on Friday 8th November 2024 will be judged and three entrants will be selected based on the above judging criteria to come to air between Monday 11th November and Wednesday 13th November 2024. 
        b).    On Wednesday 13th November 2024 all entries received between 09:00 on Friday 8th November and 09:00 on Wednesday 13th November 2024 will be judged - six entrants will be selected based on the above judging criteria to come to air between Thursday 14th November and Sunday 17th November 2024.  

11.    Entries received before or after these times will not be included in the Promotion. 

12.    The Promoter will decide which days the selected entrants will come to air and no discussion will be entered into on this matter. The selected entrants must be available to come to air or they will be excluded from the Promotion and will forfeit their prize, and we will select another entrant via the judging process outlined above. 

13.    On air these nine selected entrants will talk about their “little win” and will be awarded that day’s prize (detailed in the prize section below). They will also be asked a general knowledge question and if they answer it correctly, they will win an additional £250 spending money.  

14.    If you are this entrant and we call you, your call may be recorded for our records. You may be asked to have a call with a presenter which will either be broadcast live or pre-recorded for future broadcast. You must answer your telephone when we contact you. Someone else cannot answer the phone, participate or accept a prize on your behalf. If: (i) you fail to answer the phone; (ii) someone else answers the phone; (iii) the call goes to voicemail; (iv) the call becomes disconnected; (v) you are not (or do not seem to us to be) in a position to safely and/or lawfully take or remain on the call (for example, if you are or seem to be driving); or (vi) you are not audible or intelligible or we are not able to conduct a conversation with you in a manner that is suitable for broadcast for any reason beyond our control (including, but not limited to: low/no signal on your device, a call is dropped by any network, you are travelling, there is too much background noise or feedback, etc.); before or during the Promotion, you may be disqualified and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable. 
  
Additional prize draws: 

15.    There will be two additional prize draws taking place during the Promotion with 27 winners in total. 

16.    All eligible entries received between 17:00 on Tuesday 29th November and 09:00 on Friday 8th November 2024 will be entered into a draw, and 9 of these entries will be selected at random to win £100 cash each.  

17.    All eligible entries received between 09:00 Friday 8th November and 09:00 Wednesday 13th November 2024 will be entered into a draw, and 18 of these entries will be selected at random to win £100 cash each. 

18.    For the avoidance of doubt, these entrants will not have their Submissions judged as per clauses 3-14 and will be selected at random. 

19.    These 27 winners will be contacted within 7 days of the closing date of the Promotion via the email address or telephone number they supplied at the point of entry. 
  
20.    By submitting your entry to this Promotion, you confirm that you have obtained the consent of all individuals that feature in your Submission and agree to notify us immediately if their consent is withdrawn at any time. 

21.    Bulk, automated, machine assisted, third party, syndicate or other group entries are prohibited and we will disqualify any entries (and withhold or reclaim any associated prize from you) which, in our reasonable opinion, appear to have used any of these entry methods or, for example (without limitation), entries or votes that have been made from the same IP address, email address, postal address, telephone number, or similar or entries which we, at our sole discretion but acting reasonably, consider to be suspicious or fraudulent. 

22.    If we know or suspect you are trying to enter or have entered this Promotion by using more than one phone number or if we know or suspect you are using variations of your name, we reserve the right to disqualify any relevant entry(ies) and exclude you from this Promotion and also permanently exclude you from entering any of our Promotions. 

23.    We, the Promotion Partner and the Prize Provider may publish and publicise your submission, name, image, social media handle and/or profile picture, your nearest geographical location (for example, your nearest city, town or county) and your entry, and we may refer to your and any applicable third party’s (for example any one included in the Submission/a guest/a travel companion) association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion. 

24.    In relation to winners (and runners up if applicable), you understand that we and our Promotion Partner may: (i) interview you and your guest(s)/travel companion(s) which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion. We may also publish your and your guest(s)/travel companion(s) name, image, social media handle and/or profile picture. Any recording or filming may be broadcast either live, or as live, across the Heart Network and/or posted across Heart’s social media platforms and website. 
  
Eligibility: 
  
25.    The Promotion is only open to residents of the UK aged 18 and over, and who are based in the UK at the time of entry. 

26.    Entry is restricted to one entry per person; duplicate entries will be excluded from the Promotion. 

27.    Only one name and telephone number may be used by you in relation to this Promotion. The use of multiple names, telephone numbers and/or devices is a breach of our Promotion Terms and Conditions and we reserve the right to disqualify your entry(ies) and you will forfeit your prize should we know or have reason to believe that you attempted to use or did use more than one name, phone number and/or device to enter this Promotion. It is also prohibited for anyone else to enter the Promotion using the same phone number including household members or friends.  

28.    Before transferring any winnings to you we reserve the right to request Photo ID (such as your passport or driving licence) and confirmation that the telephone number you entered on belongs to you and proof of your home address (such as a phone bill with your name, address and telephone number on). You agree and understand that should you win a cash prize you may be required to provide these to verify your eligibility. If you fail to provide the requested information and we are unable to verify your eligibility, we reserve the right to withhold any prize from you. 

29.    The 9 winning entrants of the judged entries must be available between 10:00 – 13:00 Monday 11th November 2024 to Friday 15th November 2024 and 06:00 – 12:00 between Saturday 16th November 2024 & Sunday 17th November 2024 in order to partake in the Sky Better – Little Wins Promotion. 

Prize: 
 

30.    Between Monday 11th November – Sunday 17th November 2024 we will award the 9 winning entrants of the judged entries one of the following prizes each day Monday-Friday and two of the following prizes on both Saturday and Sunday, with the opportunity to win an additional prize for answering an additional question correctly on air (listed under ‘In addition’ below):

Monday Prize Terms & Conditions: 

38.    Your stay is subject to availability at the discretion of the Prize Provider and excludes some dates in the Christmas holidays such as Christmas Eve, Christmas Day, Boxing Day, New Year’s Eve and New Year’s Day in the UK. This experience is seasonal during the Christmas market dates which normally takes place beginning of November until end of December or beginning of January. The winner can also take the prize during the 2025-2026 period.  

39.    Your travel will be in the form of £200.00 allowance, which will be transferred directly to the winner upon confirmation of full and correct bank details. Transfers can take up to 5 working days.

 40.    You will be staying in a 4* hotel, sharing a family room with en-suite bathroom on a bed and breakfast basis. Subject to availability.

 41.    The winner’s choice of Christmas Market location in the UK from: Cardiff, Bath, Manchester, Birmingham, London, York, Nottingham, Cambridge, Liverpool, Chester, Winchester or Leeds. Ice skating at the chosen Christmas market is based on 2 adults and 2 children. This is a seasonal experience but may be taken the following year or an alternative activity can be arranged of the same value. Subject to availability and age restrictions.  

42.    Your festive dinner at the winner’s chosen restaurant is based on 2 adults and 2 children enjoying a three-course meal from the a la carte menu. All restaurant reservations are subject to availability at the time of booking. You may choose any restaurant you would like to dine in with the exception of restaurants holding Michelin stars.  

43.    Spending money will be transferred directly to the winner upon confirmation of full and correct bank details. Transfers can take up to 5 working days.  

44.    All prizes must be claimed and booked by the prize winner within 12 months from the date of the Prize Provider’s initial correspondence with them.

53.    You will be staying in a 4* castle hotel, sharing a family room with en-suite bathroom on a bed and breakfast basis. The choice of location is subject to availability.  

54.    Winner’s choice of a family friendly outdoor activity near the chosen location will be up to the value of £150.00. A representative of the Prize Provider will liaise with the winner to arrange this prize element.  

55.    Spending money will be transferred directly to the winner upon confirmation of full and correct bank details. Transfers can take up to 5 working days.  

56.    All prizes must be claimed and booked by the prize winner within 12 months from the date of the Prize Provider’s initial correspondence with them.

101.    27 winners selected at random will each win £100 cash, as described in clauses 11-15. We will transfer the cash prizes to each of these winners within 28 days of their bank details being supplied to us. You must provide all necessary details via the method directed within 14 days after the original request to do so otherwise the prize will be forfeited at our discretion. 
  
Prize terms: 
 

102.    You understand that should you win a prize package that is made up of various elements you are required to redeem all aspects of the prize in order to keep the prize. For example, if you win tickets to a gig with spending money and hotel accommodation, you will not be able to accept the spending money only. If you are unable to accept the prize awarded in full, we reserve the right to withdraw the entire prize package and select another entrant to play or win as applicable.  

103.    You must, at your own cost, comply with all necessary checks, and/or tests required for travelling to and from and entering and exiting your travel destination/venue. This includes, but is not limited to, purchasing, organising, undertaking, recording and/or registering any required Covid-19 tests. We will not be responsible for any costs incurred by you in complying with this clause, nor will we purchase, organise, undertake, record and/or register any required Covid-19 tests.  

104.    You must comply with all applicable rules, regulations and guidance relating to Covid-19, both in the UK and your travel destination/venue. We are not responsible for your failure to comply with such rules, regulations and guidance.  

105.    You acknowledge and agree that, without limitation to the provisions of Clause 12 of the General Terms & Conditions, our ability to fulfil a prize and/or perform any of our obligations under the Promotion Terms and Conditions could be affected by an actual or threatened epidemic, pandemic, disease or quarantine and/or any corresponding governmental action, guidance and/or ruling (including but not limited to any Foreign, Commonwealth & Development Office guidance) (collectively ‘Covid Measures’).   

106.    If due to any Covid Measures, we are unable to fulfil a prize or perform any of our other obligations under the Promotion Terms and Conditions, then we shall not be in breach of the Promotion Terms and Conditions. In accordance with Clause 35 below, in these circumstances, we reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion. 

107.    Any other costs and expenses which are not specifically included in the prize description are excluded and will be the sole responsibility of the winner. 

108.    The prizes are non-transferable and non-refundable. No cash alternative is available.  

109.    We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion.

Data Protection:  

111.    Your personal data that you provide to us will be collected and processed by us, our licensees (including Communicorp UK Limited) and our Promotion Partner as well as the prize providers, and if applicable, our service providers, network operators and suppliers in order to administer and fulfil the Promotion. Your personal data may also be disclosed to the Phone-paid Services Authority, Ofcom and/or the Advertising Standards Authority at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anti-social behaviour and comply with law enforcement agencies and applicable advertising codes. 

112.    By entering a Promotion, you acknowledge that any personal data provided by you in connection with the Promotion will be processed as set out above and in accordance with our Privacy Policy which sets out full details of how we process personal data and how you can exercise your rights as a data subject, and our Promotion Partner’s Privacy Policy. Please ensure you have read and understood our Privacy Policy and our Promotion Partner’s Privacy Policy before entering any Promotion. If you are required to submit a guest(s)/travel companion(s) personal data to enter a Promotion, you must ensure that your guest(s)/travel companion(s) have given you consent to provide us and our Promotion Partner with their personal data. 

113.    You may be asked if you want to opt-in to marketing from us or our Promotion Partner when you enter a Promotion. If you choose to opt-in, we or our Promotion Partner will use your personal data for marketing purposes (see Global's  Privacy Policy and our Promotion Partner’s Privacy Policy for more details). You can withdraw your consent to marketing at any time by unsubscribing.  

114.    We, our Promotion Partner and the prize providers may transfer and process personal data outside of the EEA and UK for the purposes of administering the Promotion. Where any transfers are made outside of the EEA or UK we and the Promotion Partner will ensure appropriate safeguards to protect your personal data are in place.  

115.    When you enter a Promotion we will retain your personal data for up to three years for internal purposes and to comply with our regulatory obligations. You may request the erasure of your personal data by emailing privacy@global.com. If your data is erased prior to the conclusion of a Promotion, you will forfeit your right to enter the Promotion and/or claim any prize and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.
